By accessing or using PageKit ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using PageKit on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, please do not use the Service.
We reserve the right to update these Terms at any time. We will notify you of material changes by email or by displaying a prominent notice in the dashboard. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
PageKit is a website builder platform that allows you to create, publish, and manage websites and landing pages. The Service includes:
We may modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of significant changes.
You must create an account to use PageKit. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
You must be at least 16 years old to use PageKit. If you are between 16 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Certain features of PageKit require a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually, as selected). All fees are stated in US dollars and are exclusive of applicable taxes.
Subscription pricing may change. We will provide at least 30 days' notice before a price increase takes effect on your account. You may cancel your subscription at any time from your account settings, and your access will continue until the end of the current billing period.
Free tier limits: Free accounts are subject to usage limits including page count, monthly visitor caps, and storage. We reserve the right to adjust these limits with 14 days' notice.
We offer a 14-day money-back guarantee on your first paid subscription. If you are unsatisfied within the first 14 days of your initial purchase, contact us at support@pagekit.io for a full refund.
After the 14-day window, the following no-refund policy applies:
We may grant refunds outside these cases at our sole discretion in exceptional circumstances. Contact support to discuss your situation.
You agree not to use PageKit to create, host, or distribute content that is illegal, harmful, defamatory, or infringing. Prohibited uses include but are not limited to: phishing pages, malware distribution, spam, adult content involving minors, or content that violates the intellectual property rights of others.
We reserve the right to remove any content and suspend or terminate any account that violates this policy without prior notice.
You retain ownership of all content you create and publish using PageKit. By using the Service, you grant us a limited, non-exclusive license to host, store, and display your content as necessary to provide the Service.
PageKit's software, templates, branding, and documentation are owned by us and protected by applicable intellectual property laws. You may not copy, modify, or distribute our proprietary materials without explicit written permission.
You may terminate your account at any time by visiting your account settings. Upon termination, your published pages will be taken offline and your data will be scheduled for deletion after a 30-day grace period, during which you may export your content.
We may suspend or terminate your account immediately if you violate these Terms, if we are required to do so by law, or if continued operation of your account poses a risk to the Service or other users. In cases of termination for cause, you will not be entitled to a refund of any prepaid fees.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.
To the fullest extent permitted by law, PageKit's total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim. In no event will we be liable for indirect, incidental, consequential, or punitive damages.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
Before filing any formal legal proceeding, you agree to attempt to resolve disputes informally by contacting us at legal@pagekit.io. We will make good-faith efforts to resolve the matter within 30 days.
